Shell challenges in court decision of the antimonopoly committee of ukraine

On January 17, 2017 "Alliance Holding" LLC (Shell) which operates Shell filling stations network filed a lawsuit challenging the decision of the Antimonopoly Committee of Ukraine (the AMCU) approved in October 2016 in case of alleged committing by Shell and other light fuel market operators of “anticompetitive concerted actions”, which allegedly led to restriction of price competition on the mentioned market.

17 січня 2017 року ТОВ «Альянс Холдинг» (Shell), яке відповідає за експлуатацію мережі АЗС Shell, звернулося до суду з позовом про оскарження рішення Антимонопольного комітету України («АМКУ»), прийнятого у жовтні 2016 року по справі щодо начебто вчинення Shell і іншими операторами роздрібного ринку світлих нафтопродуктів «антиконкурентних узгоджених дій», які, нібито, призвели до обмеження цінової конкуренції на зазначеному ринку.

On 21st March 2017 the first instance court announced its decision regarding the legal claim of Alliance Holding”, LLC against the Antimonopoly Committee of Ukraine (the “AMCU”). Alliance Holding”, LLC, which is Shell entity operating its retail fuel network in Ukraine, is seeking to invalidate the AMCU decision announced on 29th October 2016 that has penalized the company at almost UAH 40 mln of fine for alleged anticompetitive concerted actions on parallel pricing in fuel retail market.

21 березня 2017 року суд першої інстанції оголосив рішення щодо позову ТОВ «Альянс Холдинг» - до Антимонопольного комітету України (АМКУ). ТОВ «Альянс Холдинг» - компанія, що керує мережею АЗС Shell в Україні, вимагає визнати недійсним рішення АМКУ від 29 жовтня 2016 р., відповідно до якого на компанію було накладено штраф у розмірі майже 40 млн. грн. за нібито антиконкурентні узгоджені дії з паралельного ціноутворення на паливному роздрібному ринку.
